1.Our Services

Ease Stay provides an online travel technology and booking platform that may enable users, travel businesses, agents, partners and other authorised users to search, access, book or manage travel-related products and services, including flights, hotels, transfers and other travel products made available through the platform.

Ease Stay may also provide API, technology, white-label, integration, booking, payment-support and related services to business customers and partners.

2.Third-Party Travel Services

Ease Stay may act as a technology platform, facilitator, intermediary or booking service provider and may connect users with airlines, hotels, travel operators, suppliers and other third-party service providers (“Service Providers”).

The actual travel service is provided by the relevant Service Provider and is subject to its applicable terms, conditions, availability, fare rules, cancellation policies and other requirements.

Ease Stay does not own, operate or control all third-party travel services and shall not be responsible for the acts, omissions, availability, quality or performance of such Service Providers, except to the extent required under applicable law.

3.Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

If you use the Services on behalf of a company, organisation or another person, you confirm that you have authority to act on their behalf.

4.Account and Information

You are responsible for providing accurate and complete information and for maintaining the confidentiality of your account credentials.

You shall not misuse, share, transfer or provide unauthorised access to your account.

Ease Stay may suspend or terminate an account where it reasonably believes that the account is being misused, used fraudulently or used in violation of this Agreement or applicable law.

5.Booking and Payment

All bookings are subject to availability and confirmation.

The applicable price, taxes, service charges, convenience fees and other charges will be displayed or communicated at the time of booking, wherever applicable.

You agree to provide valid payment details and make payment within the applicable time.

A booking shall be considered confirmed only after successful payment and issuance of the applicable booking confirmation, ticket, voucher or other confirmation.

6.Cancellation and Refund

Cancellation and refund of a booking shall be governed by the applicable cancellation and refund terms of the relevant Service Provider and the Ease Stay Cancellation & Refund Policy.

Any refund received by Ease Stay from the relevant Service Provider will be processed in accordance with the applicable refund rules, after deduction of applicable charges, fees or amounts payable by the user.

7.Travel Documents

You are solely responsible for obtaining and maintaining valid passports, visas, permits, identification documents, travel insurance and other documents required for your journey.

Ease Stay shall not be responsible for refusal of boarding, entry, visa refusal, immigration restrictions or other consequences arising from inadequate or invalid travel documentation, except where caused by Ease Stay’s proven negligence or wilful misconduct.

8.User Responsibilities

You shall not:

• use the Services for any unlawful or fraudulent purpose;
• provide false or misleading information;
• make unauthorised bookings;
• attempt to interfere with the Website or Platform;
• introduce malware or harmful code;
• access or attempt to access another person’s account;
• copy, reproduce, reverse engineer or commercially exploit the Platform or its technology; or
• use the Services in violation of applicable law.

9.Intellectual Property

All rights, title and interest in the Website, Platform, software, APIs, technology, designs, content, trademarks, systems, databases and other intellectual property owned or developed by Ease Stay shall remain the property of Ease Stay or its licensors.

No ownership or intellectual property rights are transferred to the User merely by accessing or using the Services.

10.Availability of Services

Ease Stay may modify, suspend or discontinue any part of the Website or Services where reasonably necessary for maintenance, security, technical requirements, legal requirements, business reasons or circumstances beyond its reasonable control.

11.Limitation of Liability

To the maximum extent permitted by law, Ease Stay shall not be liable for indirect, incidental, special or consequential loss, loss of profits, loss of business or loss arising from third-party Service Providers, delays, cancellations or events beyond Ease Stay’s reasonable control.

Nothing in this Agreement excludes liability that cannot legally be excluded.

12.Indemnity

You agree to indemnify and hold harmless Ease Stay, its directors, employees and representatives from claims, losses, liabilities or expenses arising from your breach of this Agreement, misuse of the Services, fraudulent activities or violation of applicable law.

13.Force Majeure

Ease Stay shall not be liable for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, pandemics, war, strikes, government restrictions, technical failures, telecommunications failures, cyber incidents, supplier failures or other force majeure events.

14.Changes to this Agreement

Ease Stay may modify this Agreement from time to time. The updated version will be published on the Website. Continued use of the Services after such changes shall constitute acceptance of the updated Agreement.

15.Governing Law and Jurisdiction

This Agreement shall be governed by the laws of India. Subject to applicable law, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over disputes arising from or relating to this Agreement.
